INFORMATION FOR APPLICANT

| Brief Description of Assignment |
: |
The scopes of the work of the Legal Consultant includes, but not limited to the following:
• Legislative drafting of Rules, Regulation, Procedure and Policy;
• Providing legal opinion on critical legal issues;
• Amendment of laws, rules and regulations whenever required;
• Advising BEZA on labor-related Issues under Labor Law as adopted in BEZA;
• Time to time review of BEZA’s Laws, Rules, Procedure, Developer Agreement, RFP documents, Private EZ Developer and Operator Agreements, PEZ licenses, Land Lease Agreements and other legal instruments and preparation of draft of amendment/ modification and adjustment of changes in those legal instruments;
• Case Management, preparation of statement of facts and Affidavit in Opposition in law suits/writ cases and assisting BEZA for taking measures for properly defending BEZA in law suits /writ cases;
• Preparation of draft SROs and Gazette notifications including for incentives, zone declaration, time to time decisions of BEZA Governing Board;
• Drafting and examining the Agreements with PPP, PEZ and G2G model Developers;
• Vetting of prequalification letters and licenses for PEZs;
• Drafting memorandum of Understanding.
• Assisting BEZA Officials in day to day administrative and Zone related activities involving legal issues;
• Educating the BEZA officials on BEZA’s legal framework;
• Drafting reply to Legal Notices demanding justice;
• keeping Liaison with Solicitor, Attorney General, concerned DAG/ Privately engaged Lawyer in respect of suits/ writ petitions and with Prime Minister’s Office and Ministry of Law in respect of legislative activities;
• Preparation of legal documents for dispute resolution,
• Proving consultation services on legal issues involved in BEZA’s day to day decision making process;
• Vetting/examining of papers and legal documents prepared by BEZA Officials/coming from outside;
• Providing consultancy services for smooth implementation of One Stop Service Act and Rules;
• Advisory services to Investors on clarification of legal issues as may be required time to time;
• Translation of legal instruments from Bangla to authentic English text; and
• Any other relevant tasks as BEZA may assign time to time on matters involving legal issues that may arise during development and operational phase of economic zones. |

Educational Qualification:
The candidate should possess minimum Master’s Degree with Graduation (Hon’s) in Law from Public University or equivalent.
EXPERIENCE:
The candidate should possess minimum 10 (ten) years’ experience in judicial practice. Preference will be given to candidates having proven experience in structuring PPP Contracts, in Contract law, Company Act, rules, regulations, government notifications and amendment thereof and other legal and administrative instruments, experience in providing legal opinion, case management including drafting of replies to the court cases and legal notices. |

The shortlisting criteria are: educational qualification, experience (general & specific) and knowledge in relevant activity, hands on expansion in the activity.
