INFORMATION FOR APPLICANT

| Brief Description of Assignment |
: |
Bangladesh Railway (BR) is governed under the Railways Act, 1890 (Act No. IX of 1890). BR intends to update the Railways Act to fit it to current age & demand and to make consistent with the Government’s current laws and acts by amending existing section of the Railways Act as required; adding section of laws/acts those are enacted by the Government & applicable for railway and repealing section of existing Railways Act, those have no use at present. BR has planned to hire Consulting firm to perform the tasks. The main objectives of the Consulting firm t are as below:
1) To review, identify, mark-up and recommend changes needed for amending, adding and repealing of The Railways Act, 1890 (Act No. IX of 1890) based on the updated draft of the Railways Act, 1890 made by Bangladesh Railway’s Technical Committee.
2) To finalize the Draft Final Act both in English and in Classical Bengali language in a structured way as instructed by Ministry of Railways.
The services for the assignment shall have to be delivered within 8 (eight) months from the effective date of signing the contract. The scope of the services shall be as per TOR which is available at BR website (www.railway.gov.bd) & at procuring entity office. |

The Consulting firm(s) shall be eligible to participate and shall have the following experience and resources but not limited to:
(a) The consulting firm shall have satisfactory working experience(s) of providing similar services such in the field of law with respect to the components as mentioned in para15 above as well as described in TOR.
(b) The Consulting firm shall have number of graduate human resources with experience relevant to the assignment such as Team Leader cum Senior Consultant (Legal Expert), Moderator etc.
(c) The consulting firm shall have Physical Resources such as office, IT facility, logistical support etc.
(d) The consulting firm shall have required financial capability.

a) Detail TOR and format of CV are available in Bangladesh Railway Website (www.railway.gov.bd)
b) The Consultants shall be selected and engaged in accordance with the PPA-2006 and PPR- 2008.
c) Expression of Interests (EOI) shall be submitted in one original and two copies (one soft copy) in a sealed envelope to address given below by 09 september 2019 within 12.00 hours BST and be clearly marked with “Expression of Interest (EOI) for Selection of Consulting Firm for “Amendment and Translation into Bengali version of the Railways Act 1890 (Act No. IX of 1890)” of Bangladesh Railway.”
d) Any application submitted later than the specified date and time or submitted through telex/fax/email will not be entertained.
e) Under no circumstances Bangladesh Railway will be responsible for any cost incurred for submitting the EOI.
f) EOI Evaluation Criteria-EOI will be evaluated based on the requirements of EOI Notice and a detail criteria given below
17(a) EOI Evaluation Criteria [Supporting evidences shall have to be submitted in favor of experiences]:

(i) Eligibility Criteria The consulting firm shall have at least 7 years of working experience and shall have experience of at least 01 (one) practical experience in similar act amendment.
(ii) Background of the proposer; Age of Consulting Firm from the date of registration will have to be submitted and will be evaluated on a scale of excellent, very good, good & poor i.e.
=>20 years=excellent, =>15<20 years=very good, =>10<15 years=good, <10 years=poor.
(iii) Summary of experience of Consulting Firm in the required area of expertise Number of services in amending or ratifying Acts/Laws/Regulation/Policy/Rules of any govt./autonomous body accomplished by the proposer will have to be submitted and will be evaluated on a scale of excellent, very good, good & poor i.e.
=> 5 completed contract = excellent, =>4<5 completed contract = very good, =>3<4 completed contract = good, <3 completed contract = poor.
(iv) Summary of permanent professional employees with key qualifications Team Leader cum Senior Consultant (Legal Expert), Moderator/Translator etc.
